The questions in the ‘Exclusion grounds’ section are of the ‘Yes/No’ type, most of them displaying sub-questions in response to the answers given by the tenderers. The questions included in this section may vary according to the call for tenders concerned, depending on which questions the contracting entity deemed necessary in connection with each respective call for tenders when using structured ESPD. An answer is required for all questions defined by the contracting entity.
Some of the questions included in this section make reference to the directive or other source of law on which the question is based.
The ‘Exclusion grounds’ section contains the following subsections:
- A: Grounds relating to criminal convictions
- B: Grounds relating to the payment of taxes or social security contributions
- C: Grounds relating to insolvency, conflicts of interests or professional misconduct
- D: Other exclusion grounds that may be foreseen in the national legislation of the contracting authority's or contracting entity's Member State.
